Terms of Service
The terms that govern work carried out by Mark Excell. Written to be read, not just agreed to.
Last updated: 21 October 2026
These terms apply to all services provided by Mark Excell, sole trader, whose business address is Wittas House, Two Rivers, Station Lane, Witney, Oxfordshire, OX28 4BH (referred to throughout as "I", "me" or "my"). By engaging my services you agree to these terms.
These terms are written for business clients. If you are buying as a consumer, your statutory rights are not affected.
Scope of work
All work is carried out against an agreed brief or proposal. Any significant change to the scope of work after agreement may result in a revised cost or timeline. I will notify you of any such change before proceeding.
Work begins once the brief has been agreed in writing and any required deposit has been received.
Fees and payment
Fees are agreed in advance of work commencing. I am not VAT registered, so there is no VAT to add: all quoted fees are the total amount payable.
For project-based work, such as a new website, a deposit of 50% is payable before work begins. The remaining balance is payable on completion and before final files or website access are transferred.
For diagnostic services, including the Search Health Check, full payment is required before work begins.
Payment is by bank transfer or by secure online payment link, as set out on the invoice.
Invoices are due within 14 days of the invoice date. I reserve the right to charge interest on late payments at 8% above the Bank of England base rate under the Late Payment of Commercial Debts (Interest) Act 1998.
Monthly SEO
Monthly SEO plans (Local SEO at £395 a month and Growth SEO at £695 a month, or as agreed in your proposal) are billed monthly in advance.
- There is no minimum term. Plans run on a rolling monthly basis.
- Either of us can end a plan by giving 30 days' written notice. Email is fine. Work continues, and is payable, during the notice period.
- Each month I report in plain English on the work done and what has changed.
- Search engines and AI tools are controlled by third parties, so I cannot guarantee specific rankings, traffic or citations. I can guarantee honest advice and work prioritised by its likely effect on your business.
The Search Health Check
The Search Health Check costs £149 and is a diagnostic service. It identifies and explains issues and recommends fixes. Carrying out those fixes is not included.
Your written report is delivered within three working days of payment being confirmed, unless I tell you otherwise when you book.
If you start a monthly SEO plan with me within 30 days of receiving your report, the full £149 is credited against your first month's fee.
Introductory offer
While the introductory offer is shown on this website, the next 5 new clients to agree work with me receive one of the following:
- 25% off a monthly SEO plan for the first six monthly payments, after which the standard monthly fee applies; or
- 25% off the agreed fee for a new website project.
The offer is limited to one discount per client and applies to work agreed in writing while places remain. The number of places left is shown on the website and is kept up to date. If a monthly SEO plan ends during the discounted period, the discount ends with it. The offer cannot be combined with any other offer or credit, including the Search Health Check credit.
In return, you agree that I may publish a short case study about the work and its results. You will be able to review it before it is published, and it can be anonymised if you prefer.
Revisions and amendments
My standard project fee includes two rounds of revisions based on the agreed brief. Additional revision rounds beyond this will be charged at my standard day rate, agreed with you in advance.
Revisions requested as a result of changes to the original brief are not included in the standard revision allowance and will be costed separately.
Timelines and delivery
Estimated timelines are provided in good faith and are dependent on the timely provision of content, feedback and approvals by the client. Delays caused by late delivery of required materials may result in revised timelines.
If a project is paused for more than 30 days at the client's request, I reserve the right to reschedule it in line with current workload and to invoice for work completed to date.
Hosting, domains and changes after launch
I do not provide hosting. I will help you choose a suitable hosting provider and set up the account and your domain in your own name, so that you own and control them. Your contract for hosting and domains is directly with the provider, and their terms apply to it. I am not responsible for the provider's service, availability or charges.
For websites designed and coded from scratch without a content management system, changes after launch are made by me on request and quoted in advance. For WordPress websites, you can make content changes yourself after the handover. Ongoing support can be agreed separately to suit what you need.
Client responsibilities
You are responsible for providing accurate and complete information, content and materials required for the work. You warrant that any materials you provide do not infringe the intellectual property rights of any third party.
You are responsible for obtaining any necessary permissions or licences for content, images or other materials supplied by you for use in the project.
Intellectual property
All work created by me remains my intellectual property until full payment has been received. Upon receipt of full payment, all rights to the completed work transfer to you.
I reserve the right to display completed work as part of my portfolio unless you request otherwise in writing before the project begins.
Confidentiality
I treat all client information as confidential and will not disclose it to third parties without your consent, except where required by law. This obligation continues after the engagement has ended.
Limitation of liability
My total liability to you in connection with any engagement shall not exceed the total fees paid by you for that engagement.
I am not liable for any indirect, consequential or special loss arising from the use of or inability to use any work delivered by me, including loss of revenue, loss of data or loss of business opportunity.
Cancellation
Either party may cancel a project by giving written notice. If you cancel after work has begun, you are liable for the cost of work completed to the date of cancellation. The deposit is non-refundable in the event of cancellation by the client.
If I cancel a project, I will refund any deposit paid for work not yet started.
Monthly SEO plans are cancelled with 30 days' notice, as set out in the Monthly SEO section.
Governing law
These terms are governed by the law of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
Changes to these terms
I may update these terms from time to time. The date at the top of this page shows when they were last revised. The terms in force at the time an engagement begins are the terms that apply to that engagement.
